Wills
A will is the professional and smart way to leave a document that establishes your final wishes. A will is generally read by the court upon your death to assure that its contents are fulfilled. It is often referred to as a Last Will and Testament as well.
Trusts
A trust is an agreement and arrangement that allows another party or trustee to hold money or assets on behalf of a beneficiary. Trusts are made in different ways and decide when the assets will pass to beneficiaries.
Power of Attorney
Power of Attorney is when an agent or attorney in fact can act and make decisions on the behalf of another individual – usually someone incapacitated or unable to make decision.
Probate
Probate. The legal process whereby a person’s estate is settled and his/her property is distributed by a Judge, not pursuant to the person’s will or wishes. Having a will, trust, or other mechanism in place will reduce the likelihood that a Judge will decide who gets your property or who cares for your children after you are gone.
Guardianships
A court may appoint a guardian for a child or incompetent adult who is not able to care for himself/herself or handle his/her own finances.
